You can request all information from any organisation that relates to you under the Data Protection Act 2018. When you are involved in family court proceedings the information held by the police may well assist with your case and you are entitled to apply for it. Please note that each individual area and police force have their own regulations in respect of this request.  Also that the disclosure will only relate to you unless you have a court order clearly stating what should be disclosed. Obviously waiting for the court hearing and obtaining the order for disclosure will all take more time and you may wish to have the evidence ready and to hand to support your case.

If you are entering or heading down the path of family law proceedings and you know that these records will assist your case there is nothing preventing you from applying as early as possible.  You should determine the police force or forces in question and look at their procedures and protocols for disclosure, most of which can be found online.

We understand that this can all be very confusing and create more stress to an already stressful situation. If you require support and assistance in dealing with your family law matter or any issue that arises please contact us
