The first issue to determine is whether or not there is a current child arrangements order in place setting out the arrangements that were agreed or ordered by the court.  Should they be breached by either party, we at FLPS would suggest you remain calm and polite and do not react in front of your child or make any comments that can be construed as intimidating or pestering.  If a court order is breached we suggest keeping a full record of conversations and dates breached and then making an application to the court for enforcement or even variation of the current court order.

If there is no order and all arrangements have been made informally and amicably then perhaps set out, in writing, a proposal for the Christmas period.  This should be reasonable – taking into account the distance between you and your ex partner, the amount of travel time for your child; the age of your child; the normal routine and an offer that any agreement should be alternated each year.  If your written proposal or discussion is unsuccessful then we suggest you contact a local family mediation service to see if they can assist.

If none of the above is successful then you can apply to the courts for a child arrangements order.  This can, after being determined by the court, set out a long term arrangements including holidays, birthdays, special occasions, religious events and the normal weekly routine for the foreseeable future.  A pattern and arrangement that will give your child / children the security and routine that is so important.  We can support and assist you with this.
